Dominik is a founding partner in the firm. An avid supporter of innovative legal technology, Dominik joined Jackie in founding BC Firm because he believes that today’s business environment requires a streamlined approach grounded in the latest technology.  Technology has greatly enhanced the capacity of leaner firms to provide hands-on service to clients of all sizes.  BC Firm provides legal services with minimal overhead, and this allows the firm to tailor its services to the needs of its clients.  Dominik and Jackie formed the firm to address these issues and to provide the client community a new form of legal services less reliant on paper and more attuned to personal service.

ABOUT

He graduated from Vanderbilt University with a Bachelor of Arts in Classical Studies and Economics. He earned his J.D. from Louisiana State University’s Paul M. Hebert Law Center, where he graduated magna cum laude in the top 5% of his class and was inducted into the Order of the Coif. While he was in law school, Dominik was accepted onto the Louisiana Law Review and received the Henri Capitant Award for Outstanding Civil Law Comment. He externed for the Honorable Jeffrey P. Victory at the Louisiana Supreme Court, as well as in the Criminal Division of the Louisiana Attorney General’s Office.

 

Dominik is actively involved in New Orleans’ non-profit community, including as director of the Croatian Benevolent Association, as a project leader for the Leadership Development Series, and as legal representative for various non-profits in the New Orleans area.

 

Generally, he represents individuals and companies in a variety of practice areas, including risk management and insurance coverage litigation, cyber-security and data privacy matters, commercial litigation, labor and employment, and energy.

BUSINESS, CORPORATE & CONTRACTS

 

Dominik’s practice includes breach of contract and open account claims. Dominik has litigated shareholder and director rights disputes and has advised clients on their fiduciary obligations as officers and/or directors of corporate entities. He also has experience in the interpretation of UCC regulations concerning items, negotiable instruments, and funds transfers.

COMMERCIAL LITIGATION & BUSINESS DISPUTES

 

In this area, his practice includes significant experience in litigating business disputes and pursuing and defending claims for bad faith breach of contract, open account claims, Private Works Act claims, and general contract disputes.  Dominik’s practice has included demanding payment for services rendered, defending against Private Works Act claims (and cancelling related liens), and litigating breaches of fiduciary duty claims by directors and officers.

RISK MANAGEMENT & INSURANCE COVERAGE

 

He conducts risk management program audits for various companies. This necessarily includes an evaluation of clients’ insurance coverage as part of a client’s overall risk management practice.  Dominik has litigated claims for coverage under property, CGL, and umbrella policies, while also advising clients on the proper handling of claims made after a loss but before suit is filed.  Dominik has also advised clients on the enforceability of certificates of insurance and related misrepresentation claims.  Dominik understands that litigation is often not a desirable outcome for clients but will pursue litigation effectively when your carrier fails to follow its own policy.

CYBER-SECURITY & DATA PRIVACY

 

Dominik recognizes that the legal environment has been rapidly changing in the data privacy field and he has advised clients on the applicability of the European Union’s General Data Privacy Regulation as well as the California Online Privacy Protection Act.  Dominik has conducted audits of client data flows, practices, and procedures to ensure compliance with state, federal, and applicable international law.

ENERGY

 

He has litigated oil and gas disputes related to breaches of joint operating agreements and mineral leases. He has advised clients on the applicability of COPAS accounting requirements to potential claims arising out of their operations, and he has litigated pollution liability claims relating to oil and gas operations.

LABOR & EMPLOYMENT

 

Dominik has experience in labor and employment obligations under the Service Contract Act, the National Labor Relations Act, and the Fair Labor Standards Act. He has litigated discrimination claims, including racial, pregnancy, and disability discrimination, and has advised clients on responding to charges filed with the Equal Employment Opportunity Commission.  He has represented clients before the National Labor Relations Board and has litigated objections to audits by the Office of Federal Contract Compliance Programs. Further, Dominik has advised clients on vendor and employee agreements, including the drafting of enforceable non-competition and non-solicitation agreements.

REPRESENTATIVE MATTERS

 

  • Successfully dismissed a $1MM claim against a bank for unauthorized bank transfers through motion for summary judgment. The case involved whether bank customers could seek reimbursement of unauthorized transfers years after they had taken place.

  • Successfully dismissed discrimination claims under state and federal law, including the Americans with Disability Act.  The case analyzed an employer’s ability to require medical evaluations of disabilities under the ADA and whether a failure to cooperate with such evaluations is a legitimate ground for termination.
